A sweepstakes is a random drawing for a prize. Sweepstakes differ from a lottery as they lack consideration, or the need to purchase. Lotteries have three features: Chance, A Prize, and Consideration. Removing consideration, and applying the feature of ‘no purchase necessary’ is the basis for a sweepstakes. Sweepstakes are regulated by both state and federal law and need to be registered if the prize exceeds a predetermined amount established by local or federal guidelines.
